OBLIGATION TO APOINT A DATA PROTECTION OFFICER
The General Data Protection Regulation (DSGVO), which came into force on 25.05.2018, places numerous new data protection obligations on each company, including the one-man company (see data protection / GDPR). In particular, the GDPR prescribes the appointment of a data protection officer for many companies (Art. 37 GDPR). The Federal Data Protection Act (BDSG) substantiates this duty to appoint a data protection officer to the extent that a data protection officer is required in any case, if “in an enterprise usually at least ten people are constantly busy with the automated processing of personal data” (§ 38 BDSG). It does not matter whether the employees concerned are employed or self-employed, whether they are apprentices or experienced employees.
